1. Who we are and what this covers
Davel Inc., a California corporation, doing business as Davel Creative Agency ("Davel," "we," "us"), 655 North Central Ave, 17th Floor, Glendale, CA 91203.
This policy covers davelcreative.com and our subdomains — including customer.davelcreative.com and crm.davelcreative.com — together with our landing pages, forms, scheduling pages, portals, and our email, SMS, and phone communications.
Two things worth knowing up front:
- We use advertising and analytics technologies from Meta, Google, LinkedIn, and TikTok. Under California law that counts as "sharing" personal information for cross-context behavioural advertising, and you can opt out — see § 7.
- We do not sell your personal information for money, and we do not add you to any other company's marketing list.
2. Information we handle for our clients
When we work for a client, we often process information about that client's customers, leads, or patients ("Client Data") — for example, records in a CRM we run for them.
This policy does not cover Client Data. The client controls it, their privacy notice applies, and requests about it should go to them. We act as a service provider under written contract, process it only on the client's instructions, and do not sell or share it or use it for our own purposes.
Health information. Where a client is a HIPAA covered entity and we handle protected health information for them, we act as a Business Associate under a signed Business Associate Agreement, and HIPAA governs rather than this policy. Where we provide a CRM built on the HighLevel platform, we hold an executed Business Associate Agreement with HighLevel. Where we hold medical information for a California provider, we also handle it consistently with the Confidentiality of Medical Information Act (Cal. Civ. Code § 56 et seq.).
Please do not send patient records, client files, or other regulated data through a public form on our website. We will provide a secure channel where an engagement needs one.
3. What we collect

We do not collect biometric information. We do not seek sensitive personal information — such as government ID numbers, financial account credentials, precise location, or health data — from website visitors, and we do not use any sensitive information to infer characteristics about you.
Sources: you; your device; advertising and analytics platforms; and publicly available business sources such as LinkedIn.
4. Why we use it
To respond to enquiries and qualify fit; to provide and support our services; to invoice and collect payment; to market to you, including email, SMS where you consented, events, retargeting and audience building; to understand and improve how the Site is used; to keep our systems secure and prevent fraud; to comply with law and to establish or defend legal claims; and to evaluate job applications.
We will not use your information for a materially different purpose without telling you first.
5. Who we share it with
- Service providers under contract — hosting, CRM and marketing tools (including HighLevel), email and SMS delivery, scheduling, video meetings and transcription, cloud storage, payment processing, accounting, analytics, and IT security.
- Advertising and analytics platforms — Meta, Google, LinkedIn, TikTok and similar, through cookies, pixels, and conversion APIs. This is the "sharing" described in § 7.
- Professional advisers — lawyers, accountants, and insurers, under confidentiality.
- A buyer or successor in a merger, financing, or sale of assets.
- Where the law requires it, or to enforce our agreements or protect rights and safety. Where we are lawfully permitted and it is practical, we will try to tell you first.
We do not disclose personal information to data brokers, and we do not enrol you in anyone else's marketing programme.
6. How long we keep it
We keep personal information only as long as we need it for the purposes above, then delete or de-identify it. What we weigh: how long our relationship lasts, whether a law requires us to keep it, and whether we need it for a legal claim.
In practice this means records of an active relationship are kept for its duration; financial and tax records are kept for the period tax law requires; consent records for marketing calls and texts are kept for as long as needed to demonstrate consent; and a suppression record is kept indefinitely after you unsubscribe, so that we do not contact you again.
7. Cookies, tracking, and your advertising choices
Our Cookie Policy lists the technologies we use.
We use advertising and analytics technologies that share information with the platforms named in § 5. Under California law this is a "sale" or "share" and you have the right to opt out.

Do Not Track. There is no common industry standard for Do Not Track browser signals, and we do not currently respond to them. This disclosure is made under Cal. B&P Code § 22575(b)(5).
8. Your privacy rights
If you are a California resident, the CCPA gives you the right to know and access what we have collected, to ask us to delete it, to ask us to correct it, to receive a portable copy, and to opt out of sale or sharing. We will not treat you differently for exercising any of them.
We extend these rights to residents of every U.S. state, whether or not that state's law technically applies to us.

Verification. We will ask you to confirm information matching what we hold — usually the email address or phone number you gave us. We will not ask you to create an account. An authorised agent may act for you with your written permission and proof of authority.
Timing. We will confirm your request within 10 business days and respond within 45 calendar days, which we may extend once by a further 45 days with notice.
If we say no, we will explain why, and you may ask us to reconsider. You may also complain to the California Privacy Protection Agency (cppa.ca.gov) or the California Attorney General (oag.ca.gov).
Shine the Light. Under Cal. Civ. Code § 1798.83, we do not disclose personal information to third parties for their own direct marketing.
9. Children
The Site is for a business audience and is not directed to children under 13. We do not knowingly collect their information; if we learn we have, we will delete it. We also do not knowingly sell or share the information of anyone under 16.
10. Security
We take reasonable administrative, technical, and physical measures to protect personal information, appropriate to its nature, consistent with Cal. Civ. Code § 1798.81.5, and we require our vendors to do the same.
No system is completely secure and we cannot guarantee absolute security. Email is not a secure channel — please do not use it to send sensitive information.
If a security incident affecting your personal information occurs, we will notify you as required by Cal. Civ. Code § 1798.82 and other applicable law. For protected health information we follow the HIPAA Breach Notification Rule.

11. Artificial intelligence
We use AI-assisted tools for tasks such as drafting, audience segmentation, lead scoring, and call transcription and summarising.
No decision with a legal or similarly significant effect on you is made by automated means alone, and a person reviews AI-assisted output before it is sent to you or published. We do not use your personal information to train third-party AI models, and our vendor agreements restrict vendors from doing so with our data.
Where we produce AI-assisted patient communications for a healthcare client, those carry the disclosures California requires under Health & Safety Code § 1339.75.
12. Other sites
Our Site links to services we do not control. This policy does not apply to them. Interactions with our social media pages are also governed by that platform's own policy.
13. Where we operate
We are a U.S. business and do not target the EEA, UK, or Switzerland. Information is processed in the United States. If you are outside the U.S. and contact us, you understand your information will be handled here, where data protection law differs from your own.
14. Job applicants
If you apply for a role we collect your application materials and use them to assess your candidacy and meet employment law obligations, sharing them with recruiting and background-check vendors where relevant.
15. Changes
We may update this policy. The date above will change, and we will give reasonable notice of material changes.
